P&C Damages

Damages: Property, Bodily, Special, General, Punitive

  • Damages are the money that a person pays out when they have caused damage to someone/something.

 

There are three types of Damages and two sub-categories:

  • Property – Physical damage to tangible property like a car, house, street sign, building, etc.
  • Bodily – Physical trauma to a person including the emotional and mental anguish from the injury.
  • Special – Specific out of pocket costs for medical, bills, lost wages, etc. (easy to assess).

General – Payments for pain and suffering, mental anguish (based on feelings, subjective).

Punitive – Having to make extra payments as punishment for outrageous behavior.

 

Most of these are easy to remember, but the two subcategories are a little tricky. Here is a way to remember them.

$pecial – There is a bill that needs to be paid, you can add it up and count it.

General – Based on what a Judge or Jury feels is right, play off of G and J sounding similar.
